US Supreme Court limits power of federal agencies
The U.S. Supreme Court has overturned a 40-year-old precedent, known as Chevron, that gave deference to government agencies in interpreting the laws they administer. In a 6-3 ruling, the justices sided with fishing companies challenging a government program to monitor overfishing of herring off the coast of New England. The decision marks a defeat for President Joe Biden's administration and has significant implications for environmental regulation, public health, workplace safety and consumer protection. The Chevron precedent had been criticized by conservatives who saw it as giving too much power to government agencies, arguing that it shifted authority from judges to experts within those agencies, potentially undermining the legal system.
Chevron is overruled. Courts must exercise their independent judgment in deciding whether an agency has acted within its statutory authority.
